If you are interested in purchasing items from Victoria; and Bamba by Victoria; by way of using the online shop service, you will acquire the status of customer, (hereinafter, the "customer"), please read the following conditions carefully before starting the purchase process.

The GPC regulate the sale of products by the company CALZADOS NUEVO MILENIO, SL, hereinafter referred to as CALZADOS NUEVO MILENIO on the Website or online shop www.calzadosvictoria.com. The identification details of CALZADOS NUEVO MILENIO are as follows:

2. General Purchase Conditions (GPC) and their acceptance.

The online shop service provided by CALZADOS NUEVO MILENIO is subject to these GPC, which are supplemented by the general conditions of access and use of the website: www.calzadosvictoria.com, which the client must consult by reading both the Legal Notice and Privacy Policy of the aforementioned webpage prior to accessing the online shop, and that will be inexorably linked to these GPC with their acceptance by the client. In the event that the aforementioned general conditions of access and use of the website www.calzadosvictoria.com contain clauses that contradict these GPC, these will prevail over the former in any case.

The access, navigation and use of the Website confers the status of user (hereinafter referred to, indistinctly, individually as User or jointly as Users), so they are accepted, from the beginning of navigation on the Website, all the Conditions herein established, as well as its subsequent modifications, without prejudice to the application of the corresponding legal regulations of mandatory according to the case.

The User assumes his responsibility for the correct use of the Website. This responsibility extends to:

  • Use this Website solely for legally valid inquiries and purchases.
  • Do not make any false or fraudulent purchases. If such a purchase could reasonably be considered to have been made, it could be cancelled, and the relevant authorities informed.

As a client, you declare that you are of legal age and have sufficient legal capacity to be bound by these GPC when purchasing any product from CALZADOS NUEVO MILENIO.

To make a purchase through the CALZADOS NUEVO MILENIO online store, it will be necessary for the customer to provide the data requested for this purpose, with or without registration or signing up on the website, to confirm their purchase and to accept these GPC in the purchase form before finalising their order. These GPC are available in Spanish, English, French and Italian.

 

3. Coverage of the online shop.

The online store service is intended for end consumers, in the form established by Royal Legislative Decree 1/2007, of November 16, of the Law on Consumers and Users. Therefore, wholesale companies, distributors, purchasing centres, department stores, or other intermediaries in the footwear sector are excluded from the service.

By virtue of the foregoing, the resale of items purchased through the online store is strictly prohibited.

Regarding our B2B, a channel aimed at our customers and distributors, it will be governed by its own regulations.

The items offered through the CALZADOS NUEVO MILENIO online shop are currently distributed in Mainland Spain and the Balearic Islands, Mainland Portugal, France, Belgium, Italy, Germany and the Netherlands.

 

4. Items and information provided on the website.

All items offered on the website are a selection of products taken from the VICTORIA and BAMBA trademarks collections for men, women and children.

Each item description features the following information: item reference, item images or photos, item description, collection to which the item belongs, available sizes, price (including taxes) and shipping costs.

CALZADOS NUEVO MILENIO makes every effort within its means to offer the information contained on the Website truthfully and without spelling mistakes or errors, as well as striving to display the colours of items or products in a way that is as close to reality as possible. However, the colour of items displayed on screen may be subject to variations depending on the quality of the customer's computer screen resolution or resolution of any other device used to access the Website. However, if the written information provided on the Website does not match the item itself, the customer reserves the right to cancel their purchase incurring no cost on their part.

The availability of our items is shown in real time, so it is possible that some selected items may be found out of stock at any given moment. The CALZADOS NUEVO MILENIO online shop does not accept responsibility derived from the lack of stock of any of the products shown. Our products may change depending on the season.

Bear in mind that items loaded in the shopping basket are not reserved and may be purchased by another customer.

 

5. Purchase and registration procedure.

A) PURCHASE FORM: To make a purchase on the CALZADOS NUEVO MILENIO online store, the customer has the option to complete prior registration and open a customer account or directly access the product range, providing us with their data one step later in the process. Consequently, the customer must fill in the purchase form, or the registration or sign-up form that can be accessed by clicking on the "Create account" link. Once the customer is registered, their data will be saved for future purchases.

B) SELECTION: The customer must select the desired item(s) by clicking on its image or corresponding purchase button, after which they can then see the image, description and available sizes. Once the desired item has been chosen, the customer must choose a size and click the "Add to basket" link. If at that time the customer does not want to buy the items, they can select them and add them to the "Wish List". This particular basket does not represent an online reservation, and the next time you connect and access your "Wish List" the items that are no longer in stock may not be available.

C) MY BASKET: Once the selection process is complete, the customer can follow the purchase process by checking out or can select a new product by clicking "Continue shopping". Once the customer has selected all the items they wish to purchase, they must check that the data for them that appear in the basket are correct (model, number, pairs). Likewise, the price of each item will be displayed in the basket. The order must be confirmed by clicking "Complete purchase"; to proceed to select a payment method.

D) PAYMENT METHOD: The customer must select the desired payment method: credit or debit card or Paypal. When making payments by credit or debit card, the charge will be made in real time through the payment gateway of the relevant financial institution(bank), in an encrypted and secure way (SSL). When paying through Paypal, the process will be governed by the usual Paypal procedures.

CALZADOS NUEVO MILENIO will be in charge of keeping, insofar as it is empowered to do so, the customer's order data in a secure manner; however, in the absence of negligence, CALZADOS NUEVO MILENIO is not responsible for the losses that the client may suffer if a third party tries to access the information provided when accessing this website or when purchasing items from this website.

CALZADOS NUEVO MILENIO will not accept responsibility for delays in the delivery of the merchandise that result from the lack of authorisation by the bank. CALZADOS NUEVO MILENIO will not store the customer's bank card details as the payment will be made at the bank's payment gateway.

E) CONFIRM: Once the payment method has been selected, and before sending the order, the customer will be able to view a summary of the shipping and delivery details, the payment method used and their order.

The order must be confirmed by clicking on the "Confirm order" link. Confirmation of receipt of the order will be communicated through a confirmation e-mail; furthermore, customers already registered on the site may proceed to track their orders through the link "My orders", located on their user account page.

If an error occurs in the message, it may be a temporary communication problem with the network or an error when typing the email address provided. CALZADOS NUEVO MILENIO reserves the right to reject your order if, for example, it is not possible to obtain payment authorisation for the transaction, if shipping restrictions apply to a specific item or if the item is not in stock. In the case of the latter, we will inform you by email and we will refund all payments that have been made.

CALZADOS NUEVO MILENIO does not assume responsibility for customers or third parties in the case of removal of any merchandise from the website, even if that item has been sold; nor for the deletion, revision or edition of materials or content of the website; nor for refusing to process a transaction.

F) AVAILABILITY: All purchase orders received by CALZADOS NUEVO MILENIO through the Website are subject to the availability of the products and/or that no circumstance or cause of force majeure affects the supply of these and/or the provision of services. If there are difficulties in the supply of products or are no products in stock, CALZADOS NUEVO MILENIO undertakes to contact the customer and reimburse any amount that may have been paid. This shall also apply in cases where the provision of a service becomes impracticable.

 

6. Applicable currency and taxes.

The prices of all products on the CALZADOS NUEVO MILENIO online shop are shown in euros.

The Website will offer the customer all the information about the price and characteristics of the items before finalising the purchase process. Prices in euros shown include VAT. CALZADOS NUEVO MILENIO will not be responsible for special fees, customs duties or additional delivery costs. CALZADOS NUEVO MILENIO reserves the right to modify its retail prices at any time, except for orders that have already been placed.

 

7. Shipping costs and delivery times.

The shipping costs of items purchased through the online shop will be borne by CALZADOS NUEVO MILENIO from 19.90€. 

For lower amounts will have a cost of 5€ for Spain and Portugal and 8€ for France, Belgium, Italy, Germany and the Netherlands.

After the payment confirmation has been made and the order has been prepared for shipping, the estimated delivery time of the item is 2-3 working days for Mainland Spain and Portugal and the Balearic Islands, reserving the right to the delay of an additional day when delivering to remote areas. Regarding international orders to France, Belgium, the Netherlands, Germany or Italy, the estimated delivery time ranges from 4-5 working days.

Orders received from Monday to Thursday by 4:00 p.m. and Friday by 3:00 p.m. will be prepared and delivered to courier service the next business (working) day. Orders placed on Friday after 3:00 p.m. or at weekends will be prepared the following Monday and those placed on holidays will be processed the next business day. During company holiday periods, orders will be processed on the next business day. Holiday periods will be communicated in advance on the website and using the brands different channels.

Orders will be sent by the courier companies SEUR and DHL, in full accordance with their transport conditions.

Orders will be shipped during business hours. Therefore, to avoid delivery issues, the customer must indicate the address where the order can be delivered during these hours, as well as giving a contact telephone number.

CALZADOS NUEVO MILENIO does not deliver to PO boxes.

If for reasons of force majeure the order cannot be delivered, the full amount of the purchase will be refunded.

The CALZADOS NUEVO MILENIO online store is not responsible for delays in cases of force majeure, such as the interruption of activity or total or partial strike of the postal services and means of transport or communications, or in cases of floods or fire.

Impossibility of delivery: If the customer is not going to be at the place of delivery in the agreed time slot, he must contact the logistic company (MRW or DHL) to arrange the delivery another day.

If it proves impossible to deliver the order due to the absence of the customer on two occasions, the order could be returned to our warehouse.

In the event that it takes 30 days after your order is available for delivery, and has not been delivered for reasons not attributable to CALZADOS NUEVO MILENIO will understand that the customer wishes to withdraw from the contract and this will be considered finished. As a result of the termination of the contract, all payments received from the customer will be returned to you.

However, the customer must bear in mind that the transport derived from the resolution may have an additional cost that may be passed on to him.

 

8. Risk transfer and property

The risks that may arise from the products will be assumed by the User from the moment of delivery. The User acquires ownership of the products when CALZADOS NUEVO MILENIO receives full payment of all amounts due in relation to the purchase or acquisition made, including shipping costs, or at the time of delivery, if it takes place after this event.

CALZADOS NUEVO MILENIO is not responsible for the incorrect handling of the product by the customer, once it has been delivered.

 

9. Technical means to correct errors

The User is informed that if they detect that an error has occurred when entering the necessary data to process their purchase request on the Website, they may modify said data by contacting CALZADOS NUEVO MILENIO using the contact forms or channels enabled on the Website, and, where appropriate, through those enabled to contact customer service, victoria@calzadosvictoria.com, and/or using the contact information provided in the first clause (Identification details). Likewise, this information could also be corrected by the User through their personal connection space to the Website.

In any case, the User has access to the space, cart, or basket where their purchase requests are noted and can make modifications to the same.

Similarly, the User is referred to the Privacy Policy in order to obtain more information on how to exercise their right of rectification as established in REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, regulating the Protection of Personal Data.

 

10. Returns on purchased products or items.

If for any reason the customer is not satisfied with the purchased item, he/she may return it within 30 days from the date of delivery. You are entitled to one free return per order.

The return must be requested by the customer through our website in the section help - returns. You will need to enter your order number, billing address postcode and your e-mail address. Once inside, click on the button that says "Return products". Once the request has been received, you will receive instructions by e-mail explaining the process.

The product must not have been used, it must be in its original box in perfect condition and it is only possible to return products purchased in our online shop.

Upon receipt of the return and if these conditions are met, CALZADOS NUEVO MILENIO will refund the cost of the product upon receipt of the package by the same means of payment made by the customer in the initial purchase.

11. Right to withdrawal

The User, in their role as consumer and user, makes a purchase on the Website and, therefore, has the right to withdraw from said purchase within a period of 30 calendar days without the need for justification, as a consequence of the legal right of withdrawal provided for online shopping, reflected in item 102-108 of the Consumer Defense Law.

This withdrawal period will expire 30 calendar days from the day that the User or a third party authorised by them, other than the courier, acquired material possession of the goods purchased on the CALZADOS NUEVO MILENIO Website, or in the event that the goods comprising said order are delivered separately, 30 calendar days from the day that the User or a third party authorised by them, other than the courier, acquired physical possession of the last part of those goods that comprised the same purchase order.

To exercise this right of withdrawal, the User must notify CALZADOS NUEVO MILENIO of their decision. You can do so, where appropriate, through the contact forms and spaces provided on the Website or by writing to victoria@calzadosvictoria.com.

The User, regardless of the means they choose to communicate their decision, must clearly and unequivocally express that it is their intention to withdraw from the purchase contract. In all cases, the User may use the withdrawal form model that CALZADOS NUEVO MILENIO makes available via email if the user requests it; however, it is not compulsory to use said form.

To comply with the withdrawal period, it is sufficient that the communication made by the user unequivocally expresses their decision to withdraw and is sent before the corresponding period expires.

In the event of withdrawal, CALZADOS NUEVO MILENIO will refund the User for all payments received, without any undue delay and, in any case, no later than 14 calendar days from the date on which CALZADOS NUEVO MILENIO is informed of the decision to withdraw on the part of the user.

CALZADOS NUEVO MILENIO will refund the User using the same payment method selected by the User to carry out the initial purchase transaction. This refund will not generate any additional cost to the User. However, CALZADOS NUEVO MILENIO may retain said refund until the products or items of the purchase have been received, or until the User submits proof of their return, depending on which condition is met first.

The user must do so without any undue delay and, in any case, no later than 14 calendar days from the date on which CALZADOS NUEVO MILENIO was informed of the withdrawal decision.

The User acknowledges knowing that they must bear the direct cost of return (transport, delivery) of the goods, if any were incurred. In addition, they will be responsible for the decrease in value of the products resulting from a handling other than that necessary to establish the nature, characteristics and operation of the goods.

The User acknowledges that there are exceptions to the right of withdrawal, as stated in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. By way of example, and by no means exhaustive, this would be applicable in the case of personalised products; products that can deteriorate or expire quickly; music or video CDs/DVDs without their packaging in their original factory-sealed conditions or products that for hygiene or health reasons are sealed and have been unsealed after delivery.

Likewise, the same applies to the provision of a service that the User may contract on this Website, as this same Law establishes that the Right of Withdrawal will not assist Users when the provision of the service has been fully executed, or when it has already begun, with the express consent of the consumer and user and with the acknowledgment on their part that they are aware that, once the contract has been fully executed by CALZADOS NUEVO MILENIO, they will have lost their right of withdrawal.

In any case, no refund will be issued if the product in question has been used beyond the mere opening of it, with the explicit understanding that products that are not in the same condition in which they were delivered or that have suffered any damage after delivery shall not be accepted for refund.

Likewise, the products must be returned using or including all their original packaging, instructions and other documents that accompany them, as well as a copy of the purchase invoice receipt.


 

12. Legal guarantees

As a consumer and user, the User enjoys legal warranties on the products that he/she can purchase through this Website, under the legal terms established and subject to the current regulations regarding the purchase and sale of consumer goods, Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the Spanish General Defence of Consumers and Users Act and other complementary laws for each type of product. CALZADOS NUEVO MILENIO will therefore respond to any non-conformity within three years of the product being delivered.

Conversely, it may be the case that the User acquires a product from a brand or manufactured by a third party on the Website. In this case and considering that the User is dealing with a defective product, they also have the option of contacting the brand or manufacturer responsible for the product to find out how to exercise their legally guaranteed right directly against them during the two years following the delivery of said products. In order to exercise this right, the User must have kept all the information in relation to the guarantees pertaining to the products.

 

13. Disclaimer

Except for legal provision to the contrary, CALZADOS NUEVO MILENIO will not accept any responsibility for the following losses, regardless of their origin:

· Any losses that were not attributable to any breach on their part.

· Business losses (including lost profits, income, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred).

· Any other indirect loss that was not reasonably foreseeable by both parties at the time the contract for the sale of the products was formalised between both parties.

Likewise, CALZADOS NUEVO MILENIO also limits its liability in the following cases:

· CALZADOS NUEVO MILENIO applies all the measures concerning the provision of a faithful display of products on the Website, however, it is not responsible for the minimum differences or inaccuracies that may exist due to lack of resolution of the screen, or browser problems that is used or others of this nature.

· CALZADOS NUEVO MILENIO will act with the utmost diligence in order to make available to the company in charge of transporting the product that is the object of the purchase order. However, it is not responsible for damages arising from a courier related issue, especially for causes such as strikes, road closures or delays, and in general any other sector-specific issue which results in delays, losses or theft of the product.

· Technical failures that, due to fortuitous or other causes, prevent the normal operation of the service through the Internet. Lack of availability of the Website for maintenance or other reasons, which prevents the availability of the service. CALZADOS NUEVO MILENIO provides all possible means and channels in order to carry out the process of purchase, payment and shipping/delivery of the products, however, it is exempt from liability for causes that are not attributable to it, unforeseeable circumstances or force majeure.

· CALZADOS NUEVO MILENIO will not be held responsible for the misuse and/or wear of the products that have been used by the User. Similarly, CALZADOS NUEVO MILENIO will not be responsible for an erroneous return made by the User. It is the User's responsibility to return the correct product.

· In general, CALZADOS NUEVO MILENIO will not be responsible for any breach or delay in the fulfilment of any of the obligations assumed when it is due to events that are beyond our reasonable control, that is, due to force majeure, and this may include, by way of example but not limited to:

  • Strikes, lockouts or other industrial action.
  • Civil upheaval, revolt, invasion, threat or terrorist attack, war (declared or not) or threat or preparations for war.
  • Fire, explosion, storm, flood, earthquake, meltdown, epidemic or any other natural disaster.
  • Impossibility of use of trains, boats, airplanes, motor-based transport (including road transport) or other means of transport, public or private.
  • Inability to use public or private telecommunication systems.
  • Acts, decrees, legislation, regulations or restrictions of any government or public authority.

In this way, the obligations will be suspended during the period in which the force majeure continues, and CALZADOS NUEVO MILENIO will have the right to an extension in the term granted to fulfil them for a period of time equal to the duration of the events deemed to be force majeure.

CALZADOS NUEVO MILENIO will use all reasonable means to find a solution that allows us to fulfil our obligations despite force majeure.

 

14. Industrial and intellectual property

You acknowledge and consent that all copyright, trademark and other industrial and intellectual property rights over the materials or content that are provided as part of the website correspond at all times to us or to those who granted us a license for their use. You may make use of such material only in the way that we or those who have granted us a license to use it expressly authorise you to do so. This will not prevent you from using this website to the extent necessary to copy the information about your order or Contact details.

 

15. Viruses, piracy and other computer-based attacks

19. Nullity

If any of these Conditions were declared null and void by a firm resolution issued by the competent authority, the rest of the clauses will remain in force, without being affected by said declaration of nullity of any specific clause.

 

20. Full agreement

These Conditions and any document to which express reference is made as part of this document constitute the full agreement existing between the User and CALZADOS NUEVO MILENIO in relation to the object of sale and replace any other pact agreement or previous promise agreed verbally or in writing by the same parts.

The User and CALZADOS NUEVO MILENIO acknowledge having consented to entering into a contract without having relied on any statement or promise made by the other party, except for what is expressly mentioned in these Conditions.

 

21. Our right to modify these conditions

We reserve the right to review and modify these Conditions at any time.

22. Assignment of rights and obligations

The contract is binding both for you and for Victoria, as well as for our respective successors, assignees and successors in title.
